Terms of Service

1. The Service

InDaily is a hyperlocal discovery platform that connects users with movies, reviews, community content, and local merchant offers. We operate as an intermediary; we do not guarantee the accuracy of merchant listings, the quality of goods or services advertised, or the availability of any offer.

2. Eligibility

You must be at least 18 years old to create an account or merchant profile. By registering, you represent that you meet this requirement.

3. User Accounts

• You are responsible for maintaining the confidentiality of your login credentials.
• You must not share your account, impersonate another person, or attempt to access accounts that are not yours.
• You must not submit false, misleading, or defamatory reviews, ratings, or comments.
• You must not use automated tools to scrape, spam, or abuse the platform.

4. Merchant Listings

• Merchants are solely responsible for the accuracy of their store information, offer terms, pricing, and availability.
• Merchants must not post misleading discounts, fake expiry dates, or offers that violate applicable law (Consumer Protection Act 2019, ASCI guidelines).
• InDaily reserves the right to suspend or remove any listing that violates these terms or applicable law without prior notice.
• Final redemption decisions, including whether to honour a listed offer, remain with the merchant. InDaily is not liable for merchant conduct.

5. Subscriptions and Payments

Paid merchant plans (Starter, Growth, Premium) are activated manually by the InDaily team. To subscribe, you select a plan during onboarding and then complete payment via WhatsApp with our team. Billing is not automated at this time — you will receive a payment request before your plan is activated. Subscription fees are non-refundable except as stated in our Refund & Cancellation Policy. You may cancel at any time by contacting us; access continues until the end of the confirmed billing period.

6. Intellectual Property

InDaily's branding, design, and software are owned by us and protected by Indian copyright and trademark law. User-generated content (reviews, comments) remains yours; you grant InDaily a non-exclusive, royalty-free licence to display and index it on the platform.

7. Prohibited Conduct

• Posting illegal, obscene, or harassing content.
• Attempting to reverse-engineer, copy, or resell any part of the platform.
• Using the platform to conduct phishing, fraud, or financial scams.
• Circumventing rate limits, authentication, or access controls.

Violation of these rules may result in immediate account termination without refund.

8. Limitation of Liability

To the maximum extent permitted by law, InDaily is not liable for any indirect, incidental, or consequential loss arising from use of the platform, including failed offer redemptions, data loss, or service interruptions. Our total liability to you in any 12-month period is limited to the subscription fees you paid to us during that period.

9. Dispute Resolution

These terms are governed by the laws of India. Disputes will be resolved by arbitration under the Arbitration and Conciliation Act 1996, with seat of arbitration in Bengaluru, Karnataka. Small claims may be brought in competent courts of Bengaluru.

10. Changes to Terms

We may update these terms. Continued use after 7 days of notification constitutes acceptance. Material changes will be notified in-app.
